1. Acceptance of Terms

By accessing and using Automatic3D ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this service.

2. Service Description

Automatic3D provides AI-powered 3D model generation from text descriptions. The service:

Generates multi-view images from text prompts using AI
Creates 3D meshes in STL format from those views
Provides geometry intended for 3D printing, CAD reference, and other applications

Important: Results may vary and are not guaranteed to match exact specifications. AI generation is probabilistic and may produce unexpected, inaccurate, or unsuitable outputs. Generated models are intended as starting points and may require modification for your specific use case.

3. User Accounts

To use the Service, you must:

Create an account using Google OAuth or magic link
Provide accurate account information
Be at least 13 years old
Be responsible for maintaining account security

4. Pricing and Billing

Free Tier: 3 model generations per month at no cost. Free tier models are not stored after generation.

Pay as You Go: $2.95 per model generation beyond the free tier ($0.25 for concept views + $2.70 for mesh). Billing is metered and invoiced monthly through Stripe.

Failed Generations: If a generation fails due to a system error, we will not charge for that generation. Failures due to inappropriate or invalid prompts are not eligible for refunds.

5. Data Retention

Free tier models are not stored after generation
Paid models are stored for 30 days, then automatically deleted
You are responsible for downloading models before expiration
We are not liable for lost models after the retention period

6. Ownership and License

Your Content: You retain all rights to the 3D models you create using our service. You may use generated models for any legal purpose, including commercial use.

Our Service: We retain all rights to the Automatic3D platform, including our software, algorithms, and branding. You may not copy, modify, or reverse engineer our service.

No IP Warranty: We make no representation or warranty that generated models are free from third-party intellectual property claims. AI-generated content may inadvertently resemble existing copyrighted works, trademarks, or patented designs. You are solely responsible for conducting your own intellectual property clearance before using any generated model for commercial purposes.

7. Acceptable Use

You agree not to use the Service to:

Generate illegal, harmful, or offensive content
Create weapons, drugs, or other dangerous items
Infringe on intellectual property rights
Attempt to bypass usage limits or security measures
Resell or redistribute the service without permission
Use automated scripts to abuse the API

We reserve the right to suspend accounts that violate these terms.

8. User Responsibility for Generated Content

Your Prompts, Your Responsibility: You are solely responsible for the text prompts you submit and all content generated from those prompts. We do not review, approve, or endorse any generated content before delivery.

No Content Moderation: While we prohibit certain categories of content in our Acceptable Use policy, we do not pre-screen generated outputs. You acknowledge that you may receive unexpected or unintended results and are responsible for evaluating all generated content before use.

Intellectual Property Compliance: You represent and warrant that your prompts do not intentionally infringe on any third-party intellectual property rights. You are responsible for ensuring that your use of generated models does not violate any copyrights, trademarks, patents, or other proprietary rights.

Commercial Use Due Diligence: If you use generated models for commercial purposes, you are responsible for conducting appropriate due diligence, including intellectual property searches and legal review as needed for your jurisdiction and use case.

9. No Guarantees on Output Quality or Fitness

We make no guarantees regarding the quality, accuracy, completeness, or fitness for any particular purpose of generated models. Specifically, we do not guarantee that generated models will:

Match your expectations or the description in your prompt
Be suitable for 3D printing on any particular printer or with any particular material
Be structurally sound, watertight, or manufacturable
Be accurate in dimensions, scale, or proportions
Be suitable for CAD integration or engineering applications without modification
Meet any safety, regulatory, or compliance requirements
Be free from defects, errors, or artifacts

You are solely responsible for evaluating whether any generated model is appropriate for your intended use. We strongly recommend reviewing and testing all models before production use, 3D printing, or incorporation into any project.

10. Indemnification

You agree to indemnify, defend, and hold harmless Automatic3D, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of the Service or any generated content
Your prompts or any content you create using the Service
Any intellectual property claims related to your generated models
Your violation of these Terms of Service
Your violation of any applicable laws or regulations
Any harm caused by your use, manufacture, distribution, or sale of generated models
Any third-party claims arising from physical products created using generated models

This indemnification obligation will survive termination of your account and these Terms.

11. Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We are not liable for:

Indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, revenue, or business opportunities
Service interruptions, downtime, or unavailability
Errors, inaccuracies, or defects in generated content
Third-party service failures (payment processors, cloud providers, AI services, etc.)
Failed 3D prints, wasted materials, or printer damage
Physical harm or property damage resulting from manufactured models
Intellectual property infringement claims arising from generated content
Any use of generated models for safety-critical, medical, or regulated applications

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. We will notify you of material changes via email. Your continued use of the Service after changes constitutes acceptance of the modified terms.

14. Termination

You may delete your account at any time through the Settings page. We may suspend or terminate your account for violations of these terms. Upon termination, your models and data will be deleted according to our retention policy.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Automatic3D operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations or other urgent matters.
